Welcome to WealthSense. These Terms of Service ("Terms") govern your access to and use of the WealthSense personal finance management platform ("Service"), operated by WealthSense B.V., a company registered in The Hague, Netherlands ("WealthSense", "we", "us", or "our").
By creating an account, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. These Terms are effective as of the date you first access or use the Service.
You must be at least 16 years of age to use the Service, in accordance with the EU General Data Protection Regulation (GDPR). By using the Service, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.
To use the Service, you must create an account using an email address and password, or through Google OAuth authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Each individual may maintain only one account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss arising from unauthorized use of your account.

The Service includes AI-powered features that assist with transaction categorization and financial data organization. By accepting these Terms, you consent to the use of AI Features as described herein.
Regarding AI Features, you acknowledge and agree that:
The Service allows you to import financial data from CSV and Excel files. You are solely responsible for the accuracy and legality of any data you import. Imported files are processed and then permanently deleted from our servers. We do not retain copies of your uploaded files beyond the processing period.
WealthSense offers a 30-day free trial for new users. After the trial period, continued access requires an active subscription. We offer monthly and annual subscription plans.
All payments are processed securely through Stripe, our third-party payment processor. By subscribing, you agree to Stripe's terms of service in addition to these Terms. Your payment information is handled directly by Stripe and is not stored on our servers.
Subscriptions automatically renew at the end of each billing cycle unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
In accordance with EU consumer protection law, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason (the "cooling-off period"). To exercise this right, contact us at the address provided in Section 23. If you have already used the Service during the cooling-off period, you may be charged a proportional amount for the period of use.
You retain full ownership of all Financial Data you enter or import into the Service. We do not claim any ownership rights over your data. Your Financial Data is stored securely and processed solely for the purpose of providing the Service to you.
While we take reasonable measures to ensure data integrity, you acknowledge that the Service relies on data you provide. We are not responsible for any inaccuracies in your Financial Data or for decisions you make based on information displayed in the Service.
The Service, including its design, code, features, trademarks, and all related intellectual property, is owned by WealthSense B.V. and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial financial management purposes.
You retain all ownership rights to your Financial Data. Nothing in these Terms transfers any intellectual property rights from you to us, or from us to you, except as expressly stated.

WealthSense is a financial management tool, not a financial advisor. The Service, including investment tracking, balance sheet projections, spending analysis, and all other features, is provided for informational and organizational purposes only.
Nothing in the Service constitutes financial, investment, tax, or legal advice. You should consult qualified professionals before making any financial decisions. We are not responsible for any financial outcomes resulting from your use of the Service.
Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. We process your data in compliance with the EU General Data Protection Regulation (GDPR) and other applicable data protection laws.

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
We reserve the right to modify, update, or discontinue any part of the Service at any time. We will provide reasonable notice of any material changes that may affect your use of the Service. Continued use of the Service after such changes constitutes acceptance of the modified Service.
You may terminate your account at any time through your account settings. Upon termination, you will have a reasonable period to export your Financial Data before it is permanently deleted.
We may suspend or terminate your account if you violate these Terms, engage in prohibited uses, or if required by law. We will notify you before or promptly after any such action, except where prohibited by law.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by applicable law, WealthSense B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
Our total aggregate liability for any claims arising under these Terms shall not exceed the greater of (a) EUR 100 or (b) the total amount you paid to us in subscription fees during the twelve (12) months preceding the event giving rise to the claim. This limitation does not apply where prohibited by EU consumer protection law.
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications failures, or cyberattacks.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of The Hague, Netherlands. This does not affect your rights as a consumer under mandatory EU consumer protection regulations, which may entitle you to bring proceedings in the courts of your country of residence.
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email to the address associated with your account. Non-material changes may take effect immediately upon posting. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
